This agreement sets forth the terms and conditions for distance sales between the Provider and the Consumer.

Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) is concluded electronically between Learning Mastery TM (“Company”, “we”, “our”, “us”) and the customer (“Customer”, “you”, “your”) through the website learningmastery.app.

This Agreement governs the sale, purchase, delivery, and use of digital educational products and educational services offered through the platform.

1. Parties

Buyer

The Buyer is the natural or legal person who purchases products or services through the platform and whose billing and account information is submitted during checkout.

2. Subject of the Agreement

This Agreement regulates the rights and obligations of the parties concerning the remote sale and delivery of educational products and services available through the platform.

The platform provides, among other things:

A. Digital educational resources linked to the IELTS Mastery Series

These include:

audio resources,
video resources,
answer keys,
solutions,
additional practice materials,
continuously updated educational resources.

Access to these resources may require purchase of a corresponding book and activation of a unique access key.

B. Paid tutoring packages

Learning Mastery TM provides live educational services, including:

IELTS preparation,
general English courses,
language learning strategy programs,
tutor-led monthly training packages.

C. IELTS mock test and simulation packages

These may include:

timed computer-based IELTS simulation tests,
score reports,
AI-generated writing and speaking feedback,
temporary access periods depending on package type.

3. Physical Books and External Distributors

The platform may display, describe, and promote the IELTS Mastery, IELTS Speaking Mastery, IELTS Writing Mastery, IELTS Reading Mastery, and IELTS Listening Mastery series authored by Thomas Sow.

These books belong to Learning Mastery TM and the author.

However, physical books may be purchased through third-party distributors such as:

When the Customer is redirected to a third-party seller, Learning Mastery TM is not the seller of the physical book transaction.

For such purchases:

payment,
shipping,
delivery,
cancellation,
return,
distributor sales conditions

shall be governed by the terms of the relevant third-party distributor.

4. Order and Payment

Orders are placed electronically through the platform.

Payments are processed directly on the website through PayTR.

A sale becomes effective only when payment is successfully completed and approved.

Learning Mastery TM reserves the right not to provide access where:

payment is unsuccessful,
payment is cancelled,
payment is reversed,
fraud or suspicious activity is detected.

All prices displayed on the platform are shown in Turkish Lira (TRY) unless otherwise stated.

Applicable taxes are included unless explicitly stated otherwise.

5. Delivery of Services

Digital resources

Digital access is generally delivered immediately after:

successful payment, or
successful activation of a valid access key.

Tutoring packages

After purchase of a tutoring package, Learning Mastery TM or its tutors will contact the Customer using the provided contact information to arrange sessions.

Mock tests

Access to mock tests is granted electronically and remains valid only for the access period stated in the purchased package.

6. Trial Lessons

Before purchasing tutoring packages, prospective students may request a free trial session by contacting Learning Mastery TM.

Trial sessions are offered at the Company’s discretion and subject to availability.

7. Session Scheduling Rules for Tutoring Packages

For live tutoring packages:

all sessions must be completed within the purchased monthly period;
for every four (4) sessions, the Customer may postpone one (1) session;
postponed sessions must still be used within the same package period unless otherwise agreed in writing;
unused sessions expire at the end of the package period.

8. Right of Withdrawal

Under Turkish consumer legislation, consumers generally have a right of withdrawal in distance contracts.

However, the Customer expressly acknowledges and agrees that:

Where access to digital content begins immediately after purchase, the Customer requests immediate performance and acknowledges that the right of withdrawal may be lost once performance begins.

Tutoring packages

Once the purchased educational service has been scheduled, initiated, or partially used, withdrawal rights may be limited to the extent permitted by law.

Detailed refund and cancellation rules are set out in the Cancellation and Refund Policy.

9. No Refund After Purchase of Tutoring Packages

For tutoring packages:

a free trial opportunity is available before purchase;
once a tutoring package has been purchased, no refund is provided.

10. Customer Obligations

The Customer agrees:

to provide accurate information,
not to share account access with third parties,
not to transfer activation keys,
not to copy, reproduce, distribute, or commercially exploit the content,
not to misuse AI systems or educational tools.

11. Intellectual Property

All materials available on the platform, including:

educational content,
books,
platform content,
videos,
audios,
mock tests,
software,
AI-generated tools,
trademarks,
logos

are owned by Learning Mastery TM and/or Thomas Sow, unless otherwise stated.

No part may be reproduced, distributed, sold, shared, or used commercially without prior written permission.

12. External Resources

The platform may contain links to third-party educational tools, websites, and external resources.

Learning Mastery TM is not responsible for:

third-party content,
third-party services,
third-party availability,
third-party privacy or refund practices.

13. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Türkiye.

For disputes arising under this Agreement, the competent Consumer Arbitration Committees and Consumer Courts in Türkiye shall have jurisdiction in accordance with applicable law.

Mesafeli Satış Sözleşmesi

İşbu Mesafeli Satış Sözleşmesi (“Sözleşme”), Learning Mastery TM (“Şirket”, “biz”) ile müşteri (“Müşteri”, “siz”) arasında elektronik ortamda, learningmastery.app internet sitesi üzerinden kurulmuştur.

Bu sözleşme, platform üzerinden sunulan dijital eğitim ürünleri ile eğitim hizmetlerinin satışı, teslimi ve kullanımına ilişkin tarafların hak ve yükümlülüklerini düzenler.

Alıcı

Alıcı; platform üzerinden ürün veya hizmet satın alan ve ödeme sırasında bilgilerini sağlayan gerçek veya tüzel kişidir.

2. Sözleşmenin Konusu

Bu sözleşme, platform üzerinden sunulan eğitim ürünleri ve hizmetlerinin mesafeli satışına ilişkin tarafların hak ve yükümlülüklerini düzenler.

Platformda sunulan hizmetler arasında şunlar yer alabilir:

A. IELTS Mastery Series kitaplarına bağlı dijital kaynaklar

Bu kaynaklar şunları içerebilir:

ses dosyaları,
video içerikleri,
cevap anahtarları,
çözümler,
ek alıştırmalar,
sürekli güncellenen eğitim materyalleri.

Bu kaynaklara erişim için ilgili kitabın satın alınması ve geçerli bir erişim anahtarının kullanılması gerekebilir.

B. Ücretli eğitim paketleri

Learning Mastery TM aşağıdaki alanlarda canlı eğitim hizmetleri sunabilir:

IELTS hazırlık,
genel İngilizce,
dil öğrenme stratejileri,
eğitmen destekli aylık eğitim paketleri.

C. IELTS deneme sınavları ve simülasyon paketleri

Bunlar şunları içerebilir:

süreli bilgisayar tabanlı IELTS deneme sınavları,
puan raporları,
yapay zekâ destekli yazma ve konuşma geri bildirimi,
pakete bağlı süreli erişim.

3. Fiziksel Kitaplar ve Üçüncü Taraf Satıcılar

Platformda IELTS Mastery, IELTS Speaking Mastery, IELTS Writing Mastery, IELTS Reading Mastery ve IELTS Listening Mastery serileri tanıtılabilir.

Bu kitaplar Learning Mastery TM ve Thomas Sow’a aittir.

Ancak fiziksel kitaplar üçüncü taraf satıcılar aracılığıyla satın alınabilir. Örneğin:

Müşteri üçüncü taraf satıcıya yönlendirildiğinde, fiziksel kitap satışında satıcı Learning Mastery TM değildir.

Bu durumda:

ödeme,
teslimat,
kargo,
iptal,
iade,
satıcıya özgü satış şartları

ilgili üçüncü taraf satıcının kurallarına tabidir.

4. Sipariş ve Ödeme

Siparişler platform üzerinden elektronik ortamda verilir.

Ödemeler platform üzerinden PayTR aracılığıyla tahsil edilir.

Satış ancak ödemenin başarıyla tamamlanması ve onaylanması halinde kesinleşir.

Learning Mastery TM aşağıdaki durumlarda hizmet sunmama hakkını saklı tutar:

ödeme başarısız olursa,
ödeme iptal edilirse,
ödeme geri çevrilirse,
şüpheli işlem veya dolandırıcılık tespit edilirse.

Platformda aksi belirtilmedikçe fiyatlar Türk Lirası (TRY) cinsindendir.

5. Hizmetin Teslimi

Dijital kaynaklar

Dijital erişim genellikle:

ödemenin tamamlanmasından sonra veya
geçerli erişim anahtarının doğrulanmasından sonra

hemen sağlanır.

Eğitim paketleri

Eğitim paketi satın alındıktan sonra Learning Mastery TM veya eğitmenler, verilen iletişim bilgileri üzerinden müşteriyle iletişime geçer.

Deneme sınavları

Deneme sınavlarına erişim elektronik ortamda sağlanır ve yalnızca satın alınan pakette belirtilen süre boyunca geçerlidir.

6. Ücretsiz Deneme Dersi

Eğitim paketi satın almadan önce, aday öğrenciler Learning Mastery TM ile iletişime geçerek ücretsiz deneme dersi talep edebilir.

Deneme dersleri müsaitlik durumuna bağlıdır.

7. Ders Planlama Kuralları

Canlı eğitim paketlerinde:

tüm dersler satın alınan aylık süre içinde tamamlanmalıdır;
her dört (4) ders için müşteri bir (1) dersi erteleme hakkına sahiptir;
ertelenen dersler de aynı paket süresi içinde kullanılmalıdır;
kullanılmayan dersler paket süresi sonunda sona erer.

8. Cayma Hakkı

Türk tüketici mevzuatına göre tüketicilerin mesafeli sözleşmelerde cayma hakkı bulunmaktadır.

Ancak müşteri açıkça kabul eder ki:

Dijital içerik ve dijital hizmetler

Dijital içeriğe erişim satın alma sonrasında derhal başlıyorsa, hizmetin ifasına başlanması ile birlikte cayma hakkı ortadan kalkabilir.

Eğitim paketleri

Eğitim hizmeti planlanmış, başlatılmış veya kısmen kullanılmış ise, kanunun izin verdiği ölçüde cayma hakkı sınırlanabilir.

9. Eğitim Paketlerinde Satın Alma Sonrası İade Yoktur

Eğitim paketlerinde:

satın almadan önce ücretsiz deneme imkânı sunulabilir;
paket satın alındıktan sonra ücret iadesi yapılmaz.

10. Müşterinin Yükümlülükleri

Müşteri:

doğru bilgi vermeyi,
hesap bilgilerini paylaşmamayı,
erişim anahtarlarını devretmemeyi,
içerikleri kopyalamamayı veya ticari amaçla kullanmamayı,
yapay zekâ araçlarını kötüye kullanmamayı

kabul eder.

11. Fikri Mülkiyet

Platformdaki tüm içerikler, materyaller, kitaplar, videolar, ses dosyaları, yazılımlar, sınavlar, yapay zekâ araçları, markalar ve logolar aksi belirtilmedikçe Learning Mastery TM ve/veya Thomas Sow’a aittir.

Yazılı izin olmadan çoğaltılamaz, dağıtılamaz, satılamaz veya ticari amaçla kullanılamaz.

12. Harici Kaynaklar

Platform üçüncü taraf eğitim araçlarına veya dış bağlantılara yer verebilir.

Learning Mastery TM aşağıdakilerden sorumlu değildir:

üçüncü taraf içerikler,
üçüncü taraf hizmetler,
erişilebilirlik,
üçüncü taraf gizlilik veya iade politikaları.

13. Uygulanacak Hukuk ve Yetki

İşbu sözleşmeye Türkiye hukuku uygulanır.

Uyuşmazlıklarda yürürlükteki mevzuat uyarınca yetkili Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.
