These Terms of Service (“Terms”) govern access to and use of the website, platform, educational content, digital services, and related features operated by Learning Mastery TM through learningmastery.app.

By accessing or using the platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the platform.

1. Scope of Services

Learning Mastery TM provides educational products and services, which may include:

digital resources linked to the IELTS Mastery Series,
tutor-led educational packages,
IELTS mock tests and simulation tools,
AI-supported learning tools,

free learning resources,
educational articles, media, and practice content.

Services may change, expand, be updated, or be discontinued at any time.

2. Eligibility and User Responsibility

By using the platform, you confirm that:

the information you provide is accurate and current,
you will use the platform only for lawful purposes,
you are responsible for maintaining the confidentiality of your account credentials,
you are responsible for all activities conducted through your account.

Users must not impersonate another person or create misleading account information.

3. Account Registration

Certain services may require account registration.

You agree to:

provide accurate registration information,
keep account credentials secure,
notify Learning Mastery TM promptly if you suspect unauthorized account use.

Learning Mastery TM may suspend or restrict access if false, incomplete, or misleading information is provided.

4. Access Codes and Book-Linked Resources

Certain digital resources linked to the IELTS Mastery Series require a unique access code.

Access code rules

each code is intended for single-user use,
each code may be linked to one account only,
access codes are non-transferable,
resale, redistribution, sharing, or unauthorized reuse is prohibited.

Learning Mastery TM reserves the right to disable access where misuse is detected.

5. Physical Books and Third-Party Sellers

The platform may display or promote books authored by Thomas Sow, including:

IELTS Mastery
IELTS Speaking Mastery
IELTS Writing Mastery
IELTS Reading Mastery
IELTS Listening Mastery

Physical books may be sold through third-party distributors such as:

Learning Mastery TM is not responsible for:

third-party order fulfillment,
shipping,
returns,
third-party payment processing,
third-party sales terms.

6. AI-Powered Educational Tools

The platform may include AI-powered tools for:

writing analysis,
speaking analysis,
feedback generation,
automated learning assistance.

These tools are provided for educational support only.

Important notice

AI-generated outputs:

are not official IELTS assessments,
do not guarantee exam results,
may differ from human examiner evaluation.

Learning Mastery TM does not guarantee that AI-generated feedback will match official scoring standards.

7. Acceptable Use

You agree not to:

copy, scrape, reproduce, or redistribute platform content without permission,
share protected resources outside authorized access,
use the platform for unlawful, fraudulent, or abusive purposes,
interfere with platform security or technical systems,
attempt unauthorized access to restricted areas,
exploit AI tools for abusive, automated, or harmful use.

8. Intellectual Property

All platform content, including but not limited to:

educational materials,
books,
text,
graphics,
videos,
audio,
exercises,
mock tests,
software,
AI-related tools,
trademarks,
logos

are owned by Learning Mastery TM and/or Thomas Sow, unless otherwise stated.

No content may be copied, sold, reproduced, distributed, published, or commercially exploited without prior written permission.

9. Tutoring Services

Tutoring packages offered on the platform are subject to scheduling and availability.

Users acknowledge that:

sessions are subject to the purchased package terms,
unused sessions may expire,
refund rules are governed by the Cancellation and Refund Policy.

10. Mock Tests and Digital Access

Mock tests and other digital resources may be time-limited.

Access periods, availability, and usage limits depend on the purchased package.

Users are responsible for using access within the permitted timeframe.

11. External Links and Third-Party Resources

The platform may include links to external services, educational tools, or third-party websites.

Learning Mastery TM is not responsible for:

third-party content,
external platform functionality,
third-party privacy practices,
third-party availability,
third-party commercial terms.

Users access such resources at their own discretion.

12. Suspension and Termination

Learning Mastery TM may suspend, restrict, or terminate access without prior notice if the user:

violates these Terms,
abuses access systems,
engages in fraud,
infringes intellectual property rights,
uses the platform in a harmful or unlawful manner.

Termination may include disabling accounts, revoking access codes, or limiting service access.

13. Disclaimer of Educational Results

Learning Mastery TM provides educational tools, resources, tutoring, and feedback.

However:

no guaranteed IELTS score is promised,
no guaranteed admission, certification, or exam outcome is provided,
user performance depends on many personal factors outside the Company’s control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Learning Mastery TM shall not be liable for:

indirect losses,
consequential losses,
lost profits,
lost data,
interruption of service,
exam-related outcomes,
third-party service failures.

Platform use is at the user’s own risk.

15. Governing Law

These Terms shall be governed by the laws of Türkiye.

Any disputes shall fall under the jurisdiction of the competent Consumer Arbitration Committees and Consumer Courts in Türkiye where applicable.

16. Changes to These Terms

Learning Mastery TM may update these Terms from time to time.

Updated versions become effective once published on the platform.

Continued use of the platform after updates constitutes acceptance of the revised Terms.

İşbu Kullanım Koşulları (“Koşullar”), Learning Mastery TM tarafından işletilen learningmastery.app platformunun kullanımını düzenler.

Platforma erişerek veya platformu kullanarak bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız platformu kullanmamalısınız.

1. Hizmetlerin Kapsamı

Learning Mastery TM aşağıdaki hizmetleri sunabilir:

IELTS Mastery Series kitaplarına bağlı dijital kaynaklar,
eğitmen destekli eğitim paketleri,
IELTS deneme sınavları ve simülasyon araçları,
yapay zekâ destekli öğrenme araçları,
blog içerikleri,
ücretsiz öğrenme kaynakları,
eğitim makaleleri ve uygulama materyalleri.

Hizmetler zaman içinde değiştirilebilir, genişletilebilir veya kaldırılabilir.

2. Kullanıcı Sorumluluğu

Platformu kullanarak aşağıdakileri kabul edersiniz:

verdiğiniz bilgilerin doğru ve güncel olduğunu,
platformu yalnızca hukuka uygun amaçlarla kullanacağınızı,
hesap bilgilerinizin gizliliğinden sorumlu olduğunuzu,
hesabınız üzerinden yapılan işlemlerden sorumlu olduğunuzu.

Başka bir kişi adına yanıltıcı hesap oluşturulamaz.

3. Hesap Oluşturma

Bazı hizmetler kullanıcı hesabı gerektirebilir.

Kullanıcı:

doğru bilgi vermeyi,
giriş bilgilerini korumayı,
yetkisiz kullanım şüphesi halinde Learning Mastery TM’yi bilgilendirmeyi

kabul eder.

Yanıltıcı veya eksik bilgi verilmesi halinde erişim sınırlandırılabilir.

4. Erişim Kodları ve Kitap Kaynakları

IELTS Mastery Series kapsamındaki bazı dijital kaynaklar özel erişim kodu gerektirir.

Erişim kodu kuralları

her kod yalnızca tek kullanıcı içindir,
her kod yalnızca tek hesapla ilişkilendirilebilir,
kodlar devredilemez,
yeniden satış, paylaşım veya yetkisiz kullanım yasaktır.

Kötüye kullanım tespit edilirse erişim kapatılabilir.

5. Fiziksel Kitaplar ve Üçüncü Taraf Satıcılar

Platform, Thomas Sow tarafından yazılan kitapları tanıtabilir.

Fiziksel kitaplar üçüncü taraf satıcılar aracılığıyla satılabilir. Örneğin:

Learning Mastery TM aşağıdakilerden sorumlu değildir:

üçüncü taraf teslimat,
kargo,
iade,
üçüncü taraf ödeme süreçleri,
üçüncü taraf satış şartları.

6. Yapay Zekâ Destekli Araçlar

Platform yazma analizi, konuşma analizi, otomatik geri bildirim ve benzeri yapay zekâ araçları içerebilir.

Bu araçlar yalnızca eğitim desteği amacıyla sunulur.

Önemli not

Yapay zekâ çıktıları:

resmi IELTS değerlendirmesi değildir,
sınav sonucu garantilemez,
insan değerlendiricilerden farklı olabilir.

Learning Mastery TM, yapay zekâ çıktılarının resmi puanlama ile aynı olacağını garanti etmez.

7. Kabul Edilebilir Kullanım

Kullanıcı aşağıdakileri yapmamayı kabul eder:

platform içeriğini izinsiz kopyalamak veya dağıtmak,
korunan içerikleri yetkisiz paylaşmak,
platformu hukuka aykırı veya kötüye kullanmak,
güvenlik sistemlerine müdahale etmek,
yetkisiz erişim sağlamaya çalışmak,
yapay zekâ araçlarını kötüye kullanmak.

8. Fikri Mülkiyet

Platformdaki tüm içerikler, bunlarla sınırlı olmamak üzere:

eğitim materyalleri,
kitaplar,
metinler,
grafikler,
videolar,
ses dosyaları,
alıştırmalar,
deneme sınavları,
yazılımlar,
yapay zekâ araçları,
markalar,
logolar

aksi belirtilmedikçe Learning Mastery TM ve/veya Thomas Sow’a aittir.

Yazılı izin olmadan çoğaltılamaz, dağıtılamaz, satılamaz veya ticari amaçla kullanılamaz.

9. Eğitim Hizmetleri

Platformdaki eğitim paketleri planlama ve müsaitliğe bağlıdır.

Kullanıcı kabul eder ki:

dersler satın alınan paket şartlarına tabidir,
kullanılmayan dersler sona erebilir,
iade kuralları İptal ve İade Koşulları kapsamında düzenlenir.

10. Deneme Sınavları ve Dijital Erişim

Deneme sınavları ve dijital kaynaklar süreli erişime tabi olabilir.

Erişim süresi ve kullanım sınırları satın alınan pakete göre değişir.

Kullanıcı erişimi süresi içinde kullanmakla yükümlüdür.

11. Harici Bağlantılar

Platform üçüncü taraf hizmetlere veya dış bağlantılara yer verebilir.

Learning Mastery TM aşağıdakilerden sorumlu değildir:

üçüncü taraf içerikler,
harici platform işleyişi,
üçüncü taraf gizlilik uygulamaları,
erişilebilirlik,
üçüncü taraf ticari koşullar.

12. Askıya Alma ve Sonlandırma

Learning Mastery TM aşağıdaki durumlarda erişimi önceden bildirim yapmaksızın askıya alabilir veya sonlandırabilir:

bu koşulların ihlali,
erişim sistemlerinin kötüye kullanılması,
dolandırıcılık,
fikri mülkiyet ihlali,
zararlı veya hukuka aykırı kullanım.

13. Eğitim Sonucu Garantisi Yoktur

Learning Mastery TM eğitim materyalleri, deneme sınavları, dersler ve geri bildirim sunar.

Ancak:

belirli bir IELTS puanı garanti edilmez,
kabul, sertifika veya sınav sonucu garanti edilmez,
sonuçlar kullanıcının kişisel performansına bağlıdır.

14. Sorumluluğun Sınırlandırılması

Yürürlükteki hukukun izin verdiği azami ölçüde Learning Mastery TM aşağıdakilerden sorumlu değildir:

dolaylı zararlar,
sonuçsal zararlar,
kâr kaybı,
veri kaybı,
hizmet kesintileri,
sınav sonuçları,
üçüncü taraf hizmet hataları.

Platform kullanımı kullanıcının kendi sorumluluğundadır.

15. Uygulanacak Hukuk

Bu koşullara Türkiye hukuku uygulanır.

Uyuşmazlıklarda yürürlükteki mevzuat uyarınca yetkili Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.

16. Değişiklikler

Learning Mastery TM bu koşulları zaman zaman güncelleyebilir.

Güncellenmiş sürüm platformda yayımlandığı tarihte yürürlüğe girer.

Platformun kullanılmaya devam edilmesi yeni koşulların kabulü anlamına gelir.
